Before It's Too Late

A lump-sum gratuity is a one-time payment for: (1) insured persons with fewer than 180 months of contributions, (2) persons entitled to disability benefits, (3) survivors of deceased insured persons, and (4) foreign workers returning home permanently. A monthly pension (annuity) applies to those with 180+ months of contributions — paid every month from age 55 for life.
You must be 55 years old and have ceased being an insured person. Based on contribution period:
  • Fewer than 12 months — your own savings only, no interest
  • 12–179 months — lump sum with employer + government matching contributions
  • 180+ months — choose: lump sum or monthly pension for life
The CARE formula is the SSO Board's proposal to calculate pensions using a career-long wage average instead of the last 60 months (current method). Workers who started with low wages would receive significantly lower pensions. Dr. Boon argues this may violate Supreme Court ruling 3307/2567, which locks in vested pension rights.

Supreme Court ruling 3307/2567 established that once a Section 33 insured worker has contributed for 180+ months, their vested pension rights are locked for life — the SSO cannot retroactively apply a lower rate to reduce an already-earned pension. This ruling is the cornerstone of legal challenges against the CARE formula.
Section 33 covers employees with an employer — contributions are split between employee, employer, and government. Section 39 covers former Section 33 workers who voluntarily continue SSO coverage independently, using a fixed wage base of 4,800 THB.
